NOVA – Tomorrow, the United States Court of Appeals for the Federal Circuit, sitting en banc, will hear argument in the case of Procopio v. Wilkie, No. 17-1821. Mr. Procopio is arguing that the Federal Circuit should overturn its prior decision in Haas v. Peake and restore Agent Orange presumptive coverage to Blue Water Navy veterans. Melanie Bostwick, of Orrick, Herrington & Sutcliffe, will argue on behalf of Mr. Procopio. You can read Mr. Procopio’s principal brief HERE.

Numerous organizations, including NOVA, filed amicus briefs in support of Mr. Procopio.  NOVA was joined in its brief by the following organizations: Paralyzed Veterans of America (PVA); Military Officers Association of America (MOAA); AMVETS; and the Veterans and Military Law Section, Federal Bar Association.  NOVA retained Cate Stetson and David Maxwell, of Hogan Lovells, to represent amici.  They were assisted by NOVA Board member, Chris Attig, of Attig Steel.  You can read NOVA’s amicus brief HERE.
